recorded in the registers of Edinburgh Commissary Court, 10 July 1679

The testament dative and Inventar off the goods and debts perteaneing to vmq[uhi]ll Thomas Cunyingham factor in campheir the tyme off his deceise who deceist In the moneth off december 1678 yeirs Faithfullie maid and given up be Andro Stivensone merchand burges off Ed[inbu]r[gh] only exe[cuto]re dative decerned as creditor to the s[ai]d umq[uhi]ll defunct In swa far as the s[ai]d umq[uhi]ll defunct be ane particular accompt sub[scrivi]t with his hand off the daitt 30 day of Junii 1678 does thereby acknowledge himself to be Restane to the s[ai]d Andro Stivensone the soume off Lxxxxiij lib~ iiij s~ ij d~ fleems money as his pairt off the soumes therin mentioned as the samy[n] beirs. And sicklyk the s[ai]d vmq[uhi]ll Thomas Cunyingham be ane vth[e]r sub[scrivi]t accompt off the dait the 28 day off Julij 1678 does heirby acknowledge him to be debitor to the s[ai]d Andro Stivensone in the soume of jc~ Lxxviij lib~ xiij s~ iiij d~ fleems money As the s[ai]d accompt beirs As also the s[ai]d umq[uhi]ll defunct be ane vth[e]r accompt sub[scrivi]t with his hand off the dait the 23 day of Sep[tembe]r 1678 doeth theirby acknowledge himself to be debitor to the s[ai]d Andro Stivensone the soume off jc~ iij lib~ vj s~ vj d~ fleems money as his pairt off the soumes th[e]rin spe[cif]it As the samy[n] bars And lykwayes the s[ai]d vmq[uhi]ll Thomas Cunyingham be his accompt sub[scrivi]t with his hand off the daitt the 28 day off May 1678 doeth theirby acknowledge himself to be debitor to the s[ai]d Andro Stivensone in the soume off jc~Lxxxvj lib~ vij s~ ij d~ fleems his pairt off the soumes therin spe[cif]it As the samy[n] lykwayes conteanes And therfor the s[ai]d Andro Stivensone Is only exe[cutor]e dative decerned as creditor to the s[ai]d umq[uhi]ll Thomas Cunyingham For pay[men]t and satisfactione to him off the soume off iiijc~ xx lib~ x s~ fleemes money fors[ai]d Justly Restane off the soumes off money abovewr[itte]n Extending the samy[n] in scotts money to the soume off ijajviijc~ iij lib~ vj s~ viij d~ And sicklyk for pay[men]t and satisfactione to him off the chairges and expenssis off confirmatione off this present Testa[men]t In swa far as the said vmq[uhi]ll defunct his goods and debts underwr[itten]n will extend to and as may be Receaved be him theroff and that by de[cree]t off the Comiss[a]rs off Ed[inbu]r[gh] As the samyn off the daitt the [-] day of [-] 1679 yeirs beirs
