9 July 1741 Helen Russell & Ja[mes] Hamilton
The Testament Dative and Inventory of the Debts and Sums of money pertaining and addebted to Umquhill Helen Russell Daug[hte]r of the deceased Andrew Russell merchant in Ed[inbu]r[gh] and Relict of John Hamilton sometime Factor at Campvere thereafter merchant in Edinburgh and to Umquhill James Hamilton shipbuilder in Leith their Son The times of their respective deceases who deceased viz The said Helen Russell in North Leith in the moneth of [–] Jajvijc and [–] years and the said James Hamilton in South Leith in the month of [–] Jajvijc and Twenty [–] years Faithfully made and Given up by William Russell Commissary Clerk Depute of Edinburgh husband to and as having best knowledge in name and behalfe of Helen Hamilton his Spouse daughter Lawfull to the Said Umquhill James Hamilton and Grand Child to the said umquhill Helen Russell only Executrix dative qua nearest of Kin Decerned to them And that by decreet of the Commissars of Edinburgh as the samen of date the Seventeenth of September Jajvijc & fourty years In itselfe at more length proports
In The First the Said Umquhill Helen Russell and James Hamilton had addebted & resting owing to them the times of their respective deceases foresaid the Debts and Sums of mony aftermentioned To witt the Said Umquhill James Hamilton the sum of Seventy seven pound Sterling resting of the Sum of Five Thousand merks Scots principall & a[nnual]rents thereof Containd in a Bond granted by John Russell writter to the Signet To the deceased Gavine Stenhouse writter in Edin[bu]r[gh] be owing a[nnual]rent from the date and one Thousand merks Scots of penalty dated the first of July Jajvijc and Twenty as also in ane assignation thereof by the s[ai]d Gavine Stenhouse to the Defunct James Hamilton dated the first of June Jajvijc and Twenty one and q[uhi]lk Sum of Seventy seven pound sterl[ing] was resting at the s[ai]d Defunct his death after deduction of Two Hundered and Twenty Eight pound ten shill[ing]s Two pence halfe peny Sterling which he the defunct by his docquet to ane accompt betwixt the said John Russell and him dated the Eighteenth of Sept[e]m[be]r Jajvijc and Twenty Two years promised to allow in part payment of the Said Bond And to the said Helen Russell the Sum of one hundered pound Sterling as the Extent of her fifth share of the outstanding Executory of the said deceased Andrew Russell her father That was by her made over in Trust in favours of the Said John Russell & Intrometted with by him for which he has not yet accompted Extending the said Two Debts In haill to the Sum of one hundered and seventy seven pound sterling and in Scots money to Two Thousand one hundered and Twenty four pound Summa of the Debts owing to the Dead} ijajjcxxiiij Lib~
